Statement from Jerry Strickland, Communications Director, Office of the Attorney General: "A Kendall County jury today found former Pedernales Electric Cooperative legal counsel Walter Demond guilty of all three felony charges outlined in his June 2009 indictment. Demond was found guilty of theft, misapplication of fiduciary property and money laundering. The jury recommended that Demond receive 10 years probation and be required to pay a $10,000 fine for illegally diverting funds from the cooperative's members. As a condition of probation, State District Judge Dan Mills ordered Demond to serve 500 days in jail and pay $212,000 in restitution. We are grateful to the jurors for their service and hard work on this very important case." |

Texas politicians choose prisons over schools
A recent article in The Economist argues that conservatives can call for criminal justice reform without appearing to be tough on crime. The Lone Star State is held up as a prime example of conservative politicians turning away from mass incarceration:
Texas began tackling these problems in the last decade. In 2003 it started mandating probation rather than prison for first-time offenders caught with less than a gram of hard drugs. Two years later it gave the probation board more money to improve supervision and treatment programmes. In 2007, faced with predictions that it would need over 17,000 new prison beds by 2012, requiring $1.13 billion to build and $1.5 billion to operate, Texas allocated $241m to fund treatment programmes. Since 2003 crime of many kinds has declined in Texas. Between 2007 and 2008, Texas’s incarceration rate fell by 4.5%, while nationally the rate rose slightly. Both juvenile crime and the number of juveniles in state institutions have declined.
Over at Grits for Breakfast, Scott Henson isn’t convinced. The 2011 legislative session cut the Texas Department of Criminal Justice budget by a measly $29.1 million, but most of the programs on the cutting block are from the community supervision and diversion programming side of the budget; the budget for incarceration is only being cut by $5.5 million.
At the same time, Texas is cutting $71.5 million from the budget for Correctional Managed Health Care services while adding only $12.7 million to a grossly underfunded substance abuse treatment budget.
Budget categories traditionally associated with the tuff-on-crime policy for which Texas is famous are getting a boost: $36.8 million more for correctional security, $16.1 million more for contract prisons, private state jails, and residential parole facilities, and an additional $15 million for contracted temporary capacity.
All of this has left Henson frustrated and angry. “Instead of making plans to incarcerate fewer people,” he writes, ”the Lege chose to shift incarceration from public to private facilities with virtually no resultant savings. These priorities amount to an abandonment of the smart-on-crime reform approach for which Texas has recently received national praise.”
Meanwhile, Henson notes, Texas has made multi billion dollar cuts to education and Medicaid.
An aggregate $5.5 million cut to spending on incarcerating adult offenders is a downright offensively paltry sum at a time when education and Medicaid will experience multi-billion dollar cuts. Faced with a choice between funding schools or prisons, in other words, the Texas Legislature decided it values prisons more. I see no other way to explain the outcome except as an expression of (misplaced) legislative priorities.
Are conservative politicians in Texas leading the charge against mass incarceration? Not if this years legislative session is anything to do by. Texans have become financially dependant on the prison industry. Politicians are free to argue that we’re spending too much money on the prison system, but until actual prisons are closed and substance abuse and community supervision budgets explode dramatically we’re dealing with the same old Texas.

Ex-Newark Mayor Sharpe James Faces Lawsuit Over Campaign Funds: "
TRENTON, N.J. (CBSNewYork/AP) — The New Jersey Election Law Enforcement Commission was going after former Newark mayor Sharpe James for using campaign money to pay for his criminal defense.
James ran Newark for more than 20 years and was also a state senator before he was convicted in 2008 and sent to prison on charges of abusing his office by steering city-owned land to his one-time mistress.
ELEC has filed a civil lawsuit charging James and his campaign treasurer, Cheryl Johnson, of violating the state’s campaign finance laws. It seeks repayment of the $94,000 in campaign money, plus $6,000 in fines.
James tells The Star-Ledger that the lawsuit is baseless.
Since returning from prison, James has been working as an adviser at the Christian Love Baptist Church in Irvington.

Shun Evans Homicide Led Better
UPDATE : About 3;30 a.m., Shun Evans was approached by unknown suspects, after which they demanded money, then shot Mr. Evans and fled the scene. Mr. Evans was rushed to Baylor University Medical Center, where he was pronounced dead.

Dallas-Fort Worth : Emergency Managers around Metroplex have lots to learn
Last night exposed the vulnerability of the metroplex and the weakness of our emergency preparedness training. For instance, a tornado warning was issued with fans at The Ballpark at Arlington in the middle of the baseball game.
Stadium workers rushed fans onto the field where they were brutally assaulted by heavy hail. So they take them onto the field to receive brain damage from baseball sized hail with spikes and at times may have been grapefruit sized hail with spikes? Is that proper protocol by stadium officials?
Also with a reported tornado on the ground near Highland Park, the sirens didn't go off until much later. As we were watching the news reports, I saw a very massive funnel cloud that they kept on the screen not saying anything about it. I think they were in awe of how massive that funnel cloud was and how much damage that it could possibly do to our HIGHLY POPULATED area. Hopefully, I can find video of the funnel cloud!
The sirens should have been alarmed at the site of such a massive cloud. Just last week I wrote a brief article expressing my lack of faith in the Dallas Office of Emergency Management. Last night solidified it. We must do better.

While scrolling through today's Dallas City Council agenda, I noticed that the council would be going into executive session in regards to Mr. Collins. I wonder if they are trying to reach a settlement agreement; from the video below the city is very much liable. We will keep you up on it.

Dallas City Council to vote on refurbishing Glendale Shopping Center today.
I noticed on today's agenda that the City Council would be voting to rehab the Glendale Shopping Center. This shopping center is one of many spots located in Southern Dallas that is in dire need of a makeover.
Glendale was built in 1954, has over 58,000 square feet of rentable space, currently owned by Al Herron, and is 76% occupied with fourteen occupants. Silver Creek Investments LLC, owned by Herron is seeking grant funds from the Economic Development Corp for $600,000.
It is alleged to create 25-30 more jobs! On another note, is Club 292 still open? Al Herron should be ashamed of himself to let an establishment function in his shopping center that promotes prostitution, drug dealing and gang banging. For those unfamiliar, Aaron Alexander was murdered at 292 on August 14, 2010.

President Obama’s stuck limo is hopefully not an omen for the United States
I think we all know that the president, being very vulnerable while in transit, has a limousine designed especially for him. This vehicle is bulletproof, but it has one vulnerability: bumps.
Yes, like the super robot ED-209 in Robocop was vulnerable to stairs, the president’s limo, also known as “The Beast”, is vulnerable of getting stuck on a parking ramp. This happened in Dublin, right in front of the embassy. I am assuming the YouTube video that you can watch after the jump is footage from cellular phone cameras.
How embarrassing. Especially for the one Secret Service agent that had to get out and check to see what was up. I found it pretty amazing that some mini-bus type of vehicle took its place in blocking the way. I take it they probably made certain that president was safe.
I don’t know about you, but as an American, I find this completely funny. I always thought that the president’s security was one job that I never wanted, as there are way too many x-factors that get involved in walking around with the Commander in Chief. I wonder who got fired for not seeing this one coming.
I just can’t help but wonder if the Secret Service have a code for this. How about: “the eagle is legless”?

Why High Carbohydrate Diets After Workout is Good?
